Land division

The division of a plot of land does not (or no longer) require the approval of the building supervisory authority in order to be effective. However, upon request, the Building Regulations Department will issue a certificate of compliance with public-law regulations for the division of land.

However, the division of a plot of land must not create any conditions that contradict the ThürBO or the regulations issued on the basis of the ThürBO. It follows that in the event of violations, the building supervisory authority cannot procedurally object to the division as such, but can only take action against the unlawful consequences. This may, for example, be a building demolition order in the case of non-compliance with minimum distances.

The responsibility for compliance with building regulations in connection with the division of land lies with the landowner and his appointed surveyor.

• Application form (certificate of division)
• Extract from the real estate map (cadastral plan)
• Floor plan drawings, views, sections, possibly photos of the existing building (only required if distance areas are not adhered to or in the case of boundary construction)
• Existing or necessary building encumbrance registration § 82 ThürBO
• existing or necessary deviations according to § 66 ThürBO
• Site plan (scale not smaller than 1:500) usually 1:250

The site plan should preferably be prepared by an ÖbVI and contain the following:

• Property designation
• Green areas, access road, parking spaces
• Buildings and other structures
• Dimensions, including those of property boundaries
• Height information of existing and planned terrain
• Height classification of the buildings
• Distance area plan,
• and distance area calculation
• All supply and disposal facilities
• B- plan determinations, building encumbrances
• Legend and title block
