Rent index for residential rents

Der Mietspiegel gibt Auskunft über die ortsübliche Vergleichsmiete gem. § 558 d Bürgerliches Gesetzbuch (BGB). Diese gibt die üblicherweise gezahlten Mieten für verschiedene Wohnungstypen vergleichbarer Art, Größe, Ausstattung, Beschaffenheit und Lage wieder.

Der Mietspiegel dient als Orientierungshilfe, gleichermaßen für Mieter/-innen und Vermieter/-innen. Er kann Mieter/-innen vor ungerechtfertigten Mieterhöhungen schützen und bietet gleichzeitig Vermieter/-innen eine Übersicht über die üblicherweise gezahlten Mieten.

Er stellt neben der Benennung von drei vergleichbaren Wohnungen, dem Sachverständigengutachten und der Auskunft aus einer Mietdatenbank eine der gesetzlichen Möglichkeiten für die Ermittlung der Vergleichsmiete dar.

The current rent index was approved by the DMB Mieterverein Jena e.V.. as an interest group of tenants, and the house, apartment, and landowner association Jena e.V., as an interest group of landlords, on 30.09.2019 for the city of Jena. With the recognition it is in accordance with § 558d paragraph 1 BGB a qualified rent index. It is to be updated every two years and newly surveyed every four years. The qualified rent index has been in force for the city of Jena since 09.10.2013. The present rent index 2019 is an update of the rent index 2017 and was carried out in accordance with § 558d para 2 BGB on the basis of a random sample.

The rent index serves as a guide for tenants and landlords alike. It can protect tenants from unjustified rent increases and at the same time provides landlords with an overview of the rents usually paid.

The brochure on the rent index 2019 is available for download on this page. Furthermore, the city of Jena provides the rent index brochure in print form free of charge at the following locations:

Area of application

The rent index is basically only applicable to rented flats in residential buildings with three or more flats in the urban area of Jena, but not to detached and semi-detached houses. Furthermore, the following flats are excluded from the rent index:

  • Dwellings which have been subsidised with public funds and are thus subject to a rent and/or occupancy obligation.
  • Flats with rooms used for commercial or semi-commercial purposes
  • factory, service or caretaker apartments
  • Housing that is fully sublet
  • Apartments in homes and institutions in which additional services are provided by the landlord, e.g. catering, care, medical facilities
  • Living space in a home-like accommodation, e.g. in student or youth hostels
  • Living space that is only rented out for temporary use
  • Apartments for which a graduated rental agreement has been agreed upon
  • Dwellings with temporary tenancy agreements and fixed rent agreements for a period of more than three years
  • Apartments that are rented furnished or partially furnished
  • Apartments whose kitchen, toilet and bathroom are shared by other tenants
  • Flats that are not equipped by the landlord with a bathroom, toilet and collective heating system
