Permission for the preservation of historical monuments

Veränderungen an Kulturdenkmalen bzw. im Wirkfeld von Kulturdenkmalen (Umgebungsschutz) sind nach dem Thüringer Denkmalschutzgesetz erlaubnispflichtig. Auf Antrag prüft die Untere Denkmalschutzbehörde Maßnahmen an Kulturdenkmalen und erteilt hierzu die Erlaubnis.

Every owner of a cultural monument or a component part of a monument (in an ensemble) who wants to redesign it, repair it or change its external appearance or demolish it must obtain permission under monument protection law from the lower monument protection authority. This also applies to the erection, alteration or removal of structures in the vicinity of cultural monuments.

Earthworks also require a monument law assessment if archaeological findings are to be expected.

The lower monument protection authority examines the planned measures and grants permission in agreement with the monument authority, the Thuringian State Office for the Preservation of Monuments and Archaeology (TLDA), insofar as these can be approved. Permission can be granted with or without conditions, requirements, time limits and reservations.

In the case of measures requiring building permission, the permit is issued as part of the building permit.

In the case of projects that do not require a building permit, permission must be applied for separately.

  • Application with detailed building description (informal or using the form provided for download)
  • Site plan, photos
  • Objective in terms of monument protection law (insofar as the measure requires it)
  • If necessary, additional documents (e.g. an expert report on the history of the building or restoration of the existing building) can be requested.

In the case of projects requiring building permission, these documents are to be added to the building documents of the building application.
